Age requirements and age assurance
OpenAI requires users to be at least 13, or the minimum age required in their country to consent to use the service. Users under 18 need permission from a parent or legal guardian.
SafeGrade AI recommendation: supervised teen use only.
OpenAI uses account-provided age information and age prediction to identify eligible teen accounts. Age verification is available in some circumstances. Age prediction can misclassify users and should not be described as universal identity verification.
Eligible personal accounts identified as belonging to someone under 18 receive the ChatGPT for Teens experience automatically. Feature availability and account eligibility can vary.
Parents and guardians can link accounts to manage selected settings, including available content, feature, model-improvement, and scheduling controls. Parental controls do not let parents read or monitor a teen’s conversations. Either party can unlink the accounts; the parent is notified if the teen unlinks.
Teen safety notifications vs. adult Trusted Contact
Teen safety notifications and adult Trusted Contact are different features. For linked teen accounts, OpenAI may notify a parent or guardian in limited safety situations. These notifications are not real-time monitoring, may miss concerns, and do not provide conversation transcripts. Unlinking accounts ends notifications for that linked relationship.
Trusted Contact is an optional feature for eligible adult personal accounts, generally ages 18 and older, with a higher age threshold in some locations. It requires the nominated contact to accept an invitation. It is not an emergency service or a substitute for professional care.
Consumer conversations may be used to improve models depending on account settings. Users can turn off ‘Improve the model for everyone’; a linked parent or guardian can manage the available model-improvement setting for a teen account. Opting out excludes new conversations from model improvement. Submitting response feedback can still permit use of the associated consumer conversation. Training controls and data deletion are separate.
OpenAI publishes retention rules. Regular and archived chats generally remain saved until deleted. Deleted chats are normally scheduled for permanent deletion within 30 days, subject to exceptions such as legal or security obligations or prior de-identification. Temporary chats follow separate rules. Files saved separately in Library, projects, or custom GPTs can require separate deletion.
This evaluation covers consumer ChatGPT and does not establish the suitability of a school-managed offering. Any institutional deployment requires a separate review of student eligibility, contractual terms, privacy, administrative controls, retention, and intended use. ChatGPT Edu is marketed for universities. Purchasing an institutional agreement alone does not establish K–12 suitability or legal compliance.

Iowa’s attorney general announced on October 14, 2026 that Arizona, Arkansas, Idaho, Iowa, Kansas, Montana, Nebraska, and West Virginia had brought separate lawsuits concerning OpenAI and ChatGPT. Iowa’s petition alleges misleading consumer representations and safety failures affecting children and other users.
These are allegations, not findings established by SafeGrade AI’s review. This preliminary documentation review does not independently establish the procedural status or merits of every state case. SafeGrade AI is assessing the allegations alongside current product documentation and further testing. Requested remedies must not be described as requirements already imposed by a court.
